These Terms and Conditions of Sale ("Terms") govern your purchase of products from POMART, operated by Patrick Mayr. By placing an order through the POMART webshop, you confirm that you have read, understood, and accepted these Terms. If you have questions, please contact us before placing an order.

1.1 These Terms set out the terms and conditions applicable to your order. These Terms may change from time to time; please review the current version before submitting an order.

1.3 These Terms do not affect your statutory rights as a consumer under applicable national laws.

1.4 The sales contract will be concluded in English.

2. Order and Acceptance

2.1 Each order submitted constitutes an offer to purchase products. Orders are subject to acceptance by POMART, which may be refused at our discretion, for example if:

• The information provided is incomplete or incorrect.

• There is an error on the webshop regarding the product price or description.

• The products ordered are no longer available.

2.2 If you believe your order was rejected in error, please contact us promptly.

3. Product Availability

POMART reserves the right to update product information, including prices, descriptions, and availability, at any time without notice. Once your order is accepted, no changes to price, availability, or description will be made for the ordered product.

4. Changes and Cancellations

4.1 You may modify or cancel your order before it has been processed.

4.2 If your order has been dispatched, you cannot cancel it. Please see our Return Policy for information on returns and refunds.

5. Delivery

5.1 Some products may not be available for all countries. Any territorial restrictions will be indicated before purchase.

5.2 Shipping costs depend on order value and destination. Customs duties, tariffs, and taxes are the responsibility of the buyer.

5.3 Delivery dates are estimates and cannot be guaranteed.

5.4 POMART may deliver your order in separate shipments.

5.5 Ownership of physical products transfers to you upon delivery and full payment. You are responsible for the product from that point forward.

5.6 For digital products (e.g., downloads, digital artworks), access is granted upon successful payment, and you are responsible for maintaining your own digital devices and data.

6. Prices and Payment

6.1 Product prices include VAT (if applicable) and are as displayed at the time of order.

6.2 Payment is required in full when placing an order. Available payment methods are displayed at checkout. Online payments may be processed by third-party providers.

6.3 Payments by credit card: The payment provider acts as the merchant of record; Patrick Mayr provides the products. Any claims related to the payment itself should be directed to the payment provider.

7. Returns and Refunds

7.1 Faulty or damaged products: You may return or exchange products that arrive damaged, faulty, or not as described. Please contact POMART as soon as possible to arrange returns.

7.2 Digital products: Due to the nature of digital content, downloads cannot be refunded once delivered unless faulty or not as described.

8. Intellectual Property

8.1 All content, images, artworks, and products provided by POMART remain the intellectual property of Patrick Mayr unless explicitly stated otherwise.

8.2 You may not reproduce, distribute, or use the content for commercial purposes without prior written permission.

9. Liability

9.1 Nothing in these Terms excludes or limits liability for fraud, death, personal injury, or other liability which cannot legally be excluded.

9.2 POMART is not liable for:

• Loss of profit, revenue, or business.

• Loss or corruption of data.

• Indirect or consequential losses.

11. Governing Law and Dispute Resolution

11.1 These Terms are governed by the laws of Norway, without regard to its conflict of laws principles.
